Grounds for Divorce

In recent years, there has been a rapid increase in the number of divorces. As so many people get divorced, the grounds for divorce naturally increase and diversify. Divorce reasons generally consist of 3 main headings. The first of these is "divorce by mutual consent". In divorces by mutual consent, if there are children, the individuals decide among themselves who they will stay with, and they also reach a financial agreement and can submit this protocol they have prepared to the judge in court.

Severe Incompatibility

In second place are general divorces, also known as "severe incompatibility", which are among the most common reasons for divorce. Generally, there is serious communication breakdown and severe incompatibility in relationships. The person initiating the lawsuit must prove that they are not at fault in this situation and must present evidence and witnesses regarding the incompatibility between them. The third type of divorce is based on specific grounds for divorce. Among these reasons are adultery, a life that offends honor, an attempt on the person's life, mistreatment, beating, violence, and abandonment for a long period, especially more than 6 months. These are listed among the grounds for divorce. When situations not covered by the law are encountered in divorce cases, the case outcome is finalized by the Court of Cassation. The case is decided based on the statements of the parties and witnesses. Our laws generally contain provisions that protect women.
