How to Obtain a Residence Permit for Foreigners

What Should Undocumented Foreigners Do?

Obtaining a residence permit, known as a residence certificate, is mandatory for those who enter Turkey without a visa and wish to stay longer in the country. Foreigners have the right to obtain a 6-month tourist certificate, and a tourist residence certificate is valid for 1 year. The required documents for residence permits vary depending on reasons such as tourism, study, or marriage. The main documents include the original passport, 4 photos, a photocopy of the passport, a notarized lease agreement if living in a rented property, a notarized undertaking from the Turkish citizen if staying with them, general health insurance, and a valid mobile phone number. The Directorate General of Migration Management issues work permits for foreigners and residence permits. Undocumented foreigners whose residence period and visa in Turkey have expired cannot obtain a residence permit. Undocumented foreigners brought to the Kumkapi foreigner gathering center and deported are often banned from entering the country for 5 months or 5 years.

Residence Permit for Those Married to Turkish Citizens

The Directorate General of Migration Management requires documents such as the original and photocopy of the marriage certificate, the original and photocopy of the passport, and a criminal record for foreigners residing in our country due to marriage. Additionally, the foreigner must obtain a criminal record from the Turkish consulate in their home country, and this document must bear an apostille seal. If the spouse, who is a citizen of the Republic of Turkey, does not have any insurance, private health insurance is required for both the Turkish citizen and the foreigner. With the foreign work permit issued by the T.R. Ministry of Labor and Social Security, foreigners can reside in any city they wish and engage in any work they desire. Foreigners residing abroad can obtain a work permit by applying to T.R. Consulates. According to the Law on Foreigners and International Protection, foreigners who leave the country voluntarily without being apprehended are not banned from entering Turkey. No penalty is applied to foreigners who re-enter within 90 days after leaving Turkey. No prohibition is applied to foreigners who come to the border gate on their own initiative without exceeding the 10-day period for work permits, residence permits, and visa exemptions.
